Intellectual Property Rights

This policy outlines the intellectual property rights of Hayxo LLC and the responsibilities of customers when submitting designs, artwork, or other content for use in custom orders. By using hayxo.com, you agree to this policy.

1. Hayxo's Intellectual Property

hayxo.com and all of its content — including but not limited to the Hayxo logo, brand name, website design, graphics, photographs, product images, templates, artwork, text, fonts, and software tools (collectively, "Hayxo Content") — are the copyrighted and trademarked property of Hayxo LLC or parties from whom Hayxo has licensed such property.

All rights in hayxo.com and the Hayxo Content are reserved worldwide. It is strictly prohibited to copy, reproduce, distribute, publish, modify, or commercially exploit any portion of the Hayxo Content without our express prior written consent.

2. Customer-Submitted Designs

Hayxo offers custom jersey and uniform design services that allow customers to submit artwork, logos, names, numbers, and other design elements ("Designs") for use in their orders. You retain full ownership of any Designs you submit to Hayxo.

By submitting a Design, you represent and warrant that you are the original owner of that Design or have obtained all necessary rights, licenses, and permissions to use it — and to authorize Hayxo to use it solely in fulfilling your order.

Hayxo does not review Designs before submission. By uploading a Design to hayxo.com, you assume full legal responsibility for that Design and its compliance with this policy and all applicable laws.

3. License Granted to Hayxo

By submitting a Design for a custom order, you grant Hayxo LLC a limited, non-exclusive, worldwide, royalty-free license to use, reproduce, prepare, manipulate, and transmit your Design solely for the following purposes:

Processing, producing, packaging, and shipping your order
Displaying a preview of how your Design will appear on our products
Using your completed product image in Hayxo marketing, advertising, and promotional materials (e.g., social media, website galleries, product showcases)

If you do not wish your completed order to be featured in Hayxo's promotional materials, please notify us at support@hayxo.com before or at the time of placing your order.

This license does not grant Hayxo the right to sell, resell, or commercially distribute your Design independently of your order.

4. Your Warranties & Representations

By submitting a Design to hayxo.com, you represent and warrant that your Design does not and will not:

Infringe Third-Party IP Rights: Your Design must not infringe, misappropriate, or violate any copyright, trademark, service mark, trade secret, or other intellectual property right owned by any third party, including professional sports leagues, teams, brands, or artists.
Violate Privacy or Publicity Rights: Your Design must not include the likeness, name, or image of any identifiable individual without their express written consent.
Contain Unlawful or Harmful Content: Your Design must not contain content that is threatening, abusive, defamatory, obscene, fraudulent, hateful, or otherwise unlawful under applicable US or international law.
Be Subject to Outstanding Disputes: You warrant that there are no existing legal disputes, claims, or challenges regarding the intellectual property rights in your Design or any part thereof.

5. Prohibited Content in Designs

Hayxo reserves the right to refuse, remove, or decline to produce any Design that includes:

Official logos, wordmarks, or trademarks of any professional or collegiate sports league, team, or organization without proper licensing
Celebrity names, likenesses, or images without documented written consent
Copyrighted artwork, photography, or graphic designs owned by third parties
Content that promotes hate speech, discrimination, violence, or illegal activity
Sexually explicit or obscene imagery
Content that violates the rights of any individual or entity

Submission of a prohibited Design does not obligate Hayxo to produce the order. Hayxo may suspend, cancel, or refuse any order containing non-compliant content without prior notice.

6. Minors in Submitted Designs

If your submitted Design contains the likeness of any identifiable individual under the age of 18, you represent and warrant that you have obtained written consent from that individual's parent or legal guardian prior to submission. We strongly encourage you not to include personally identifying information — such as a minor's full name or address — in any such Design.

7. Design Review & Removal

Hayxo reserves the right — but is not obligated — to review any Design submitted for compliance with this policy. We may refuse to use any Design and may suspend processing of any order we determine to be in violation.

We may also request written confirmation of any rights, licenses, or permissions you hold in relation to a submitted Design. Failure to provide satisfactory confirmation may result in the removal of your Design and suspension or termination of your account.

We recommend keeping backup copies of all Designs in your own personal storage. Hayxo is not responsible for the loss of any submitted Design files.

8. Sports League Disclaimer

All custom jerseys and uniforms produced by Hayxo are independently designed and manufactured. Hayxo's products are not affiliated with, endorsed by, licensed by, or produced under authorization from any professional or collegiate sports league, team, association, or brand — including but not limited to the NFL, NBA, MLB, NHL, MLS, FIFA, or any other governing sports body.

Any team names, numbers, player names, or design elements included in a custom order are supplied by the customer and are the sole intellectual property responsibility of the customer.

9. Trademarks & Brand Assets

The Hayxo name, logo, and all associated trademarks and service marks — whether registered or unregistered — are the exclusive property of Hayxo LLC and may not be used in connection with any product or service not affiliated with Hayxo, or in any manner likely to cause confusion, or in any way that disparages Hayxo.

All other trademarks appearing on hayxo.com that are not owned by Hayxo are the property of their respective owners. Nothing on this Site should be construed as granting any license or right to use any Hayxo trademark without our express prior written consent.

10. DMCA & Copyright Complaints

Hayxo respects the intellectual property rights of others. If you believe that any content on hayxo.com infringes your copyright or trademark, please notify us at support@hayxo.com with the following:

Your full name, address, telephone number, and email address
A description of the copyrighted work or trademark you claim has been infringed
A description of the infringing content and its location on our Site
A statement of good-faith belief that the disputed use is not authorized by the rights owner, its agent, or the law
A statement, made under penalty of perjury, that the above information is accurate and that you are authorized to act on behalf of the rights owner
Your electronic or physical signature

Hayxo will respond to valid, DMCA-compliant notices promptly. Repeat infringers may have their accounts suspended or terminated.

11. Indemnification

You agree to indemnify, defend, and hold harmless Hayxo LLC and its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, and expenses — including reasonable legal fees — arising from:

Your violation of this Intellectual Property Rights Policy
Any Design you submit to hayxo.com
Any claim that your submitted Design infringes the IP or other rights of any third party
Your activities in connection with obtaining products or services from Hayxo
Any unauthorized access to or use of your Hayxo account

12. Policy Changes

Hayxo reserves the right to update or modify this policy at any time. Changes will be posted on this page with an updated Effective Date. Your continued use of hayxo.com following any changes constitutes your acceptance of the revised policy.
